Terms & Conditions

1. Agreement
By submitting a booking inquiry, hiring Caranci Creations, or checking the agreement box on any Caranci Creations form, you (“Client”) agree to these Terms & Conditions in full. These terms govern all photography services provided by Mateo Caranci, doing business as Caranci Creations (“Photographer”).
2. Photo & Media Release
By engaging Caranci Creations, Client grants Photographer a perpetual, royalty-free, worldwide license to use, reproduce, edit, publish, and display photographs and video taken during the session or event for any lawful purpose, including but not limited to:
- The Caranci Creations website and online portfolio
- Social media accounts operated by Caranci Creations
- Print or digital advertising and promotional materials
- Entry into photography competitions or exhibitions
No additional compensation will be owed to Client for such use. Client waives any right to inspect or approve the final use of the images.
Minor athletes: If any individual photographed is under 18 years of age, the parent or legal guardian submitting the booking form represents that they have authority to grant this release on behalf of the minor and does so by agreeing to these terms.
Photographer will not sell individual images to third-party stock agencies or use images in a manner that is defamatory or misleading.
3. Services & Deliverables
Photographer will make reasonable efforts to capture requested subjects and moments; however, no specific shot, moment, or outcome is guaranteed. Sports and live events are unpredictable and Photographer cannot guarantee coverage of every play, athlete, or highlight. Final edited images will be delivered via the Caranci Creations client gallery within the timeframe agreed upon at booking.
4. Payment
All fees are due as agreed at the time of booking. Failure to complete payment may result in withholding of gallery access or deliverables. Prices are subject to change; quoted prices are locked in once a booking is confirmed in writing.
5. Cancellations & Rescheduling
Client may cancel or reschedule by contacting Photographer at least 48 hours before the scheduled session. Cancellations with less than 48 hours notice may forfeit any deposit paid. Game cancellations due to weather or school decisions will be rescheduled at no additional charge when reasonably possible.
6. Limitation of Liability
Photographer's total liability to Client for any claim arising out of or related to photography services shall not exceed the total fees paid by Client for the specific session giving rise to the claim.
Photographer is not liable for:
- Failure to capture specific moments due to conditions outside Photographer's control (weather, lighting, venue restrictions, event cancellations)
- Equipment malfunction, media corruption, or data loss beyond Photographer's reasonable control
- Injury to Client or any athlete, parent, or attendee at the event
- Any indirect, incidental, consequential, or punitive damages of any kind
Photographer is an independent contractor, not an employee of any school, team, or athletic organization. Photographer assumes no responsibility for venue safety, crowd control, or the conduct of event participants.
7. Intellectual Property & Copyright
All photographs, images, videos, and visual content produced by or displayed on this website are the exclusive intellectual property of Mateo Caranci, doing business as Caranci Creations, and are protected under United States copyright law (17 U.S.C. § 101 et seq.) and applicable international copyright treaties.
Client receives a personal, non-exclusive, non-transferable license to use delivered images for personal use only (printing, sharing, personal display). Client may not resell, sublicense, commercially exploit, reproduce for commercial gain, or distribute images without prior written permission from Photographer.
Prohibited uses include but are not limited to:
- Downloading, copying, or reproducing any image displayed on this website without written authorization
- Using any image from this website in advertising, commercial products, or for-profit purposes
- Removing, altering, or obscuring any watermark, copyright notice, or attribution associated with any image
- Reverse-engineering, scraping, or systematically downloading content from this website
- Republishing or redistributing any content from this website on another platform without attribution and written consent
Unauthorized use of any photograph or content from this website constitutes copyright infringement and may subject the infringer to civil and criminal liability, including statutory damages of up to $150,000 per work under 17 U.S.C. § 504.
8. Website Design & Originality
The design, layout, code, branding, copy, and visual identity of this website — including color palette, typography, section structure, and user interface — are original works created for and owned by Caranci Creations. This website and its design are protected by copyright and trade dress law.
Any claim that this website, its design, or its content was copied from or misappropriated from any third party is expressly denied. Caranci Creations asserts full original ownership of this site's creative expression. Photography, web development, and design industries commonly share structural conventions (e.g., hero sections, portfolio grids, contact forms); the presence of similar structure does not constitute copying.
You may not copy, reproduce, replicate, or substantially imitate the design, layout, branding, color scheme, or visual identity of this website for any purpose, commercial or otherwise, without the express written permission of Caranci Creations. Doing so may constitute copyright infringement and/or trade dress infringement under applicable law.
If you believe in good faith that content on this website infringes your copyright, please send a written notice to mcaranci07@gmail.com with sufficient detail for Caranci Creations to evaluate the claim. False or bad-faith infringement claims may themselves give rise to legal liability.
9. Privacy
Photographer collects only the information necessary to fulfill the booking (name, email, event details). This information is not sold to third parties. Contact information may be used to follow up on your booking and deliver your gallery. You may request deletion of your personal data at any time by emailing mcaranci07@gmail.com.
10. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Rhode Island, without regard to conflict of law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms, the services provided by Caranci Creations, or any alleged infringement of intellectual property rights — including unauthorized use of photographs, copying of website design, or false claims of ownership — shall be resolved exclusively through litigation in the state or federal courts located in Rhode Island.
By using this website or engaging Caranci Creations, you consent to personal jurisdiction in Rhode Island and waive any objection to venue in that jurisdiction. This means that if you violate these Terms — including by stealing, copying, or misusing content from this site — the matter will be brought before a court of law and settled there, not through informal negotiation or social pressure.
Caranci Creations reserves the right to seek injunctive relief, statutory damages, and attorney's fees to the fullest extent permitted by law for any infringement of these Terms.
11. Changes to These Terms
Photographer reserves the right to update these Terms at any time. The date at the top of this page reflects the most recent revision. Continued use of Caranci Creations services constitutes acceptance of the current Terms.
